March 12, 2010: “Based on military law, General Sarath Fonseka cannot be tried before a military tribunal,” said the JVP Parliamentary Group Leader Anura Kumara Dissanayake addressing a media briefing held today.
“Based on military law, General Sarath Fonseka cannot be tried before a military tribunal. This is because legal scholars who interpret the Army Act have clearly said that such a tribunal can be held for all ranks other than for the Army commander.
"If the Army Commander has committed an incorrect act, then the President can immediately remove him. Our legal team is now ready to argue this fact next Tuesday and point out that General Sarath Fonseka cannot be tried before such a tribunal,” said Dissanayake..
