March 12, 2010: A habeas corpus petition has been filed by Mrs. Anoma Fonseka, that General Sarath Fonseka, in the custody of the Army at present, be released after producing him before the Appeal Court.
The petition has cited General Sarath Fonseka, Army Commander Lieutenant General Jagath Jayasuriya, Head of the Military Police Brigadier E. K. J. K. Wijesiri, Navy Commander Vice Admiral T. S. P. Samarasinghe and the Attorney General.
Stating that General Sarath Fonseka had provided leadership to the Sri Lanka Army to defeat terrorism, the petitioner has pointed out that even the Defence Secretary acknowledged that General Fonseka was an excellent Army commander.
The petition mentions that as General Fonseka has retired from the Army, he no longer comes under the control of the Army.
As such, Mrs. Anoma Fonseka requests that General Fonseka be produced before the Appeal Court and dealt with under the ordinary law of the country.
She further requests that General Fonseka be released under any conditions the court sees fit.
