Supreme Court dismissed the Fundamental Rights Petition filed by Shanil Nethicumara aiming to prevent an imminent arrest of him.
Nethicumara is alleged to have threatened the family of a witness who testified before the Bond Commission.
Shanil Nethicumara had called the mobile of Vijitha Wijesuriya, the brother of Anika Wijesuriya and issued “open death threats” on October 14, 2017.
A written complaint over the incident was made to the Presidential Commission of Inquiry
Why did Shanil Nethicumara threaten the Wijesuriya family?
July 2017 – Anika Wijesuriya testified before the Presidential Commission of Inquiry into the Bond Scam.
She testified regarding the Penthouse apartment of then-Minister of Finance Ravi Karunanayake.
After the complaint was made about the death threat, the commission directed the matter to CID probable offences under the Penal Code and Protection of Victims of Crime and Witnesses Act.
Thereby, the Criminal Investigations Department conducted an inqury and reported facts via a ‘B Report’ to the Fort Magistrates Court on the October 26, 2017.
According to the B Report, Vijitha Wijesuriya had recorded the threat by Nethicumara via another mobile phone.
This is how that conversation, said to be the one between Wijesuirya and Nethicumara unfolded;
Shanil Nethicumara: For what you did to my uncle machan, I will you know, I kill all you f****** remember that.
Vijitha Wijesuriya: Sorry?
Shanil Nethicumara: What you did to UNCLE RAVI machan, I will show you f****** interest remember that.
Vijitha Wijesuriya: You will what?
SN: For what you’ll did to my uncle machan..
SN: You know machan, in 2001 machan gave your father machan the post. But what you’ll did has (Inaudible) So now machan, I am openly telling you, I’ll give you an open threat. Dont get caught to me because I’ll definitely hit all you f****** with a bottle, all of you.
SN: Don’t get caught to me. I will smash all you buggers. Don’t get caught to me machan. You’ll made 600 million rupees from UNCLE RAVI’s apartment complex. Now let’s play the game. Be careful, I won’t tell you shut the f***** us and cut the phone.
The Criminals Investigation Department had informed Shanil Nethicumara to provide a statement on several occasions.
However, reports say Nethicumara failed to appear.
Though Shanil Nethicumara failed to appear before the Magistrates Court, he filed a petition with the Supreme Court through his attorneys.
He has requested to prevent any attempt to arrest him -but failed to be present at the Supreme Court today (November 28) when the petition was taken up.
During the court session, Senior Additional Solicitor General Viraj Dayaratne has named Nethicumara a ‘fugitive’ and that he cannot seek special treatment from court.
Thus the petition of Shanil Nethicumara was dismissed as ‘baseless’.
